STANDARD INSTRUCTIONS, CLAUSES AND CONDITIONS

Pursuant to the Department of Public Works and Government Services Act (S.C. 1996, c. 16), the General Terms and Conditions B, identified in the GCSurplus.ca website by date, and title are incorporated by reference and form part of the bid solicitation and resulting contract as though expressly set out in the bid solicitation and resulting contract.

  1. SECURITY REQUIREMENTS
    1. There is no security requirement.
  2. REQUIREMENTS
    1. For the purchase, pick-up, and removal of the Asset(s) described in Section 2.2 on an "as and when requested basis" for the duration of the period of the Contract as detailed in Section 5.0 entitled Term of Contract.
    2. Details of the Asset(s):
      1. Assets: Contaminated Scrap Metal:
        1. Consisting of assorted metal materials, which will include unspecified quantities of plastic, wood, cardboard, etc., which may be attached to scrap metal. May contain up to twenty-five percent (25%) of non-metallic items in the lot. Two (2) pictures are included in the sale to demonstrate the type of items requiring pick-up.
    3. Work Requirements:
      1. Contaminated Scrap Metal:
        1. On request, the contractor shall leave one container on the site of a capacity of twenty (20) yards as directed by and to the satisfaction of the custodian. A bigger container would cause problems when offloading and loading.
        2. The container might need to be delivered and picked up after working hours.
        3. When delivering the container, the driver will need to place wooden blocks under the container, as per the example in the picture with the red container. Wooden blocks are available on-site, however, the driver has the responsibility to put them in place.
        4. Full containers shall be removed within twenty-four (24) hours of notification by the custodian and an empty container must be delivered if required.
        5. The drop-off site has height restrictions, and a sprinkler line is present (red pipe in one of the pictures).
        6. The custodian may request a container of a different size than the one requested in Section 2.3.1.1 to satisfy the needs of the project.
        7. Weight scale tickets are essential; merchandise sold by weight shall be weighed near the point of loading on an independent public or other scale approved by the custodian.
        8. The contractor shall pay the cost of the weight scale tickets. The contractor shall remit within two (2) working days the weight scale tickets to GCSurplus and the custodian.
        9. The custodian shall keep GCSurplus informed of removals as they occur. Failure to provide the referenced weight scale tickets as indicated will result in termination of the period contract.
        10. All weight scale tickets must be in accordance with the "Unit of Issue" as shown on the Offer to Purchase.

    4. Any Contract will be for the actual quantity of Asset(s) that Canada requests the Purchaser to purchase during the period of the Contract and will not constitute an agreement by Canada to sell any or all of the said Asset(s). The quantity of Asset(s) sold under the Contract may be more or less than the Estimated Quantity of Asset(s) and the Estimated Extended Price specified herein.
    5. Upon request, the Purchaser must provide the required number of containers, of appropriate size, on designated government sites, remove, weigh, and purchase the Asset(s) in accordance with the terms and conditions of the Contract.
    6. The loading and removal of the Asset(s) are the sole responsibility of the Purchaser and at the Purchaser's own expense.
  3. ESTIMATED QUANTITY AND ESTIMATED EXTENDED PRICE
    1. The estimated quantity of Asset(s) and its corresponding estimated extended price specified herein are only an approximation of requirements given in good faith. The Purchaser will have no claim against GCSurplus for shortages. Amounts in excess of the Estimated Quantity or Estimated Extended Price will be paid in accordance with the Basis of Payment specified herein.
  4. SECURITY DEPOSIT
    1. A security deposit in the form of a certified cheque or an irrevocable standby letter of credit made out to the Receiver General for Canada of an amount up to twenty percent (20%) of the estimated extended price of the Sales Contract is a condition precedent to Sales Contract award. Should the Purchaser fail to respect fully his/her obligations under the Sales Contract, the deposit will be forfeited to GCSurplus. Such forfeiture must not limit or curtail any of GCSurplus rights as stipulated by law or in the Sales Contract.
  5. TERM OF CONTRACT
    1. Period of the Contract :
      1. The period of the Contract is from 15/03/2023 to 31/05/2024 inclusively.
  6. INVOICING
    1. The GCSurplus Sales Representative will send an invoice upon receipt of the weight scale ticket.
    2. Invoices must be paid in full, within thirty (30) days from the date of the invoice.
  7. APPLICABLE LAWS
    1. The Contract must be interpreted and governed, and the relations between the parties determined, by the laws in force in Québec.

Payment and Removal
Payment:
The Purchaser agrees to make any payment requested (see available payment options) by the Minister within 3 calendar days from the date of such request and prior to removal of any of the property.
 
Removal:
The Purchaser, upon acceptance of this offer by the Minister and after payment in full has been received by the Minister, shall at their expense, pack, load and remove the property by the date indicated on the bill of sale or, if no date is shown, within 3 calendar days after the date the bill of sale is issued.
