SPECIAL REQUIREMENTS FOR THE COLLECTION AND TRANSPORT OF BATTERIES

  1. The purchaser must provide the appropriate sealed shipping material that meets industry standards.
  2. The vehicle / equipment used to perform the work must be certified for the type of work.
  3. Training WHMIS: Buyer MUST ensure that all employees are trained in WHMIS and produce, on GCSurplus' request, the relevant documentation proving that they are competent in this matter and that their training is current.
  4. The purchaser shall comply with all standards set out in the Act on Transport of Dangerous Goods (TDG) and any other provincial and/or federal regulation for handling, packaging and shipping the materials above and assumes no liability for damage, injury or death. The buyer understands that no action or claim may be brought by anyone against Canada, PWGSC (and GCSurplus client department) or their designated representative having custody of the property for any loss or damages of any kind arising from the use of GCSurplus or the possession, ownership, transport or use of property purchased from GCSurplus.
  5. The buyer understands and acknowledges that the lead batteries he will obtain in this sale must be recycled. The buyer must recycle lead acid batteries in a manner that is consistent with laws, regulations and other requirements of the jurisdiction in which it is located (federal, provincial and municipal) applicable to the following areas: environment, public health and safety, labor, and hazardous waste (collection, storage, transport and treatment).
  6. The buyer understands and also acknowledges that, if he decides to dispose of the batteries in a manner other than recycling them, all provisions of the province will apply to the buyer, since it will be considered be the producer of waste.

Payment:
The Purchaser agrees to make any payment requested (see available payment options) by the Minister within 3 calendar days from the date of such request and prior to removal of any of the property.
 
Removal:
The Purchaser, upon acceptance of this offer by the Minister and after payment in full has been received by the Minister, shall at his expense, pack, load and remove the property by the date indicated on the bill of sale or, if no date is shown, within 5 calendar days after the date the bill of sale is issued.

For all offsite sales, the client department is only responsible for making the sale items accessible for removal. They are under no obligation to provide assistance of any kind. It is the Purchaser's responsibility to ensure they have the proper labour and material handling equipment to facilitate the removal. Failure to comply with this condition of sale may lead to the purchaser being turned away and the items and funds being forfeited.
