Terms and Conditions of Sale:

Removal

  • All associated removal costs including but not limited to: transport, logistics, labour, equipment, insurance costs, etc. will be the responsibility of the Purchaser.
  • The Purchaser must submit a removal plan that details how the removal will be carried out, the personnel and equipment required on-site to effectuate the work and the estimated time for completion.
  • The Removal plan must be approved by GCSurplus and NRC. If removal plan is deemed unacceptable it may result in the cancellation of the contract.
  • The Purchaser must prepare and remove the assets on-site in accordance with the approved removal plan.
  • The Purchaser will only be permitted to commence work on or after June 6th.
  • All on-site removal work must be completed within twenty five (25) concurrent business days
  • Removal must be completed no later than August 15th.
  • The Purchaser is responsible for the cleanup of the removal site daily after removal of the assets and/or scrap materials and bi-products taking place to the satisfaction of NRC or its representative(s) and must dispose of any waste materials in accordance with the latest environmental regulations.
  • Minimum clean-up requirement and site information: 
    • At its own expense, the Purchaser must sweep the assigned area with no observable debris left behind before leaving the removal site.
    • At its own expense, the Purchaser must remove all hazardous or petroleum-based material resulting directly from any equipment leak.
    • The work site must be returned to its original state upon completion of work or as instructed by the NRC authority for the duration of the project.
    • NRC or its or designated representative will witness the removal as it is being performed and can stop the removal activities at any time to ensure that it is being performed in a safe manner.

Insurance

  • A minimum of $5 million dollar Commercial General Liability Insurance and $2 million Automobile Insurance is a mandatory requirement.

Payment and Deposit

  • A security deposit in the form of a certified cheque, bank draft or an irrevocable standby letter of credit as accepted and approved at the discretion of the GCSurplus Sales Representative, made out to the Receiver General for Canada of an amount of two-thousand five hundred dollars ($2,500.00), is a condition precedent to Contract award. Should the Purchaser fail to respect fully his/her obligations under the Contract, the deposit will be forfeited to GCSurplus. Such forfeiture must not limit or curtail any of GCSurplus rights as stipulated by law or in the Contract.
  • Payment, security deposit, approved removal plan, proof of insurance, and COVID-19 vaccination certification are required within 14 days of contract award.

Safety

  • The Purchaser must adhere to all federal and provincial occupational health and safety regulations at all times throughout the duration of the contract.

Site Access and Support

  • Access to the assets will be restricted to the hours of operation of the site. The current hours of operation are from Monday to Friday 7:00 a.m. to 5:00 p.m. (EST) Eastern Standard Time
  • Magna Management may provide access to just the plant to The Purchaser to accommodate a flexible schedule. During removal, Magna will isolate their work area and would thereby act as "contractors" to manage this area and their own time.
  • NRC reserves the right to extend, by mutual agreement with the Purchaser, the on-site access hours to facilitate timely removal of the assets.
  • Canada Support to Purchaser :
    • To aid the Purchaser in the removal of assets, the following support will be provided by if available at Canada's sole discretion:
      • Consultation with the NRC representative(s) and Canada's specialists
      • Additional technical information
      • The Purchaser is advised that this Article does not represent a commitment by Canada and that it is the Purchaser's sole responsibility to provide all services required to carry out the work detailed above. The Purchaser must be able to work independently on all aspects of the required services.

Vaccination Policy

  • This sale is subject to the COVID-19 Vaccination Policy
  • In accordance with the COVID-19 Vaccination Policy for Supplier Personnel, all Bidders must provide with their bid, the COVID-19 Vaccination Requirement Certification attached to this bid solicitation, to be given further consideration in this sales process.
  • Failure to complete and provide the COVID-19 Vaccination Requirement Certification as part of the bid will render the bid non-responsive

Payment and Removal
Payment:
The Purchaser agrees to make any payment requested (see available payment options) by the Minister within 14 business days from the date of such request and prior to removal of any of the property.
 
Removal:
The Purchaser, upon acceptance of this offer by the Minister and after payment in full has been received by the Minister, shall at their expense, pack, load and remove the property by the date indicated on the bill of sale or, if no date is shown, within 25 business days after the date the bill of sale is issued.

Buyers are advised to contact each asset custodian listed on the sale to determine what viewing and pick-up directions are in place as instructions may vary from location to location. The item(s) described herein are being sold offsite and not from a GCSurplus Sales Centre. For all offsite sales, Canada is responsible for making the sale items accessible for removal. They are under no obligation to provide assistance of any kind. It is the Purchaser's responsibility to ensure they have the proper labour and material handling equipment to facilitate the removal. Failure to comply with this condition of sale may lead to the Purchaser being turned away and the items and funds being forfeited.
